TERMS AND CONDITIONS

GENERAL

1. These standard terms and conditions apply to competitions (“the campaign”) conducted by or promoted by or offered by Payflex (Pty) Ltd (“the Promoter”) in association with third parties. “Promotion” specific rules may apply in addition to these standard terms and conditions. In the event of a conflict between these standard terms and conditions and any competition specific rules, the “Promotion” specific rules shall apply.
2. The following people are excluded from entering the competition; directors, members, partners, employees, agents, service providers and consultants of Payflex (Pty) Ltd as well as their spouses, life partners, immediate family members, business partners and associates (referred to as 'The Organizers').
3. “Festive Campaign” will run from Friday, 1 December 2023 until Tuesday, 25 December 2023.
4. “Festive Campaign” winners will be contacted in January 2024. Winners will be randomly selected by Payflex.
5. Payflex reserves the right to disqualify any entrants who fail to follow the rules set out in these Terms and Conditions are suspected of engaging in fraud or any entrant who makes any misrepresentation relating to the offer.
6. Payflex is not responsible for any technical failures, malfunctions, problems with or damage to equipment (including but not limited to wireless devices, websites, wireless networks, servers, computer hardware or software) during the Promotion Period or as a result of you participating in the offer.
7. Payflex reserves the right, at its sole discretion, to cancel, suspend, cut short or extend the offer.
8. Payflex's Pay Later terms apply to the use of Payflex's products.

THE CAMPAIGN

1. Users who enter the competition stand to win 1 of 25 daily giveaways. This only applies to Payflex registered users who have shopped at selected “Festive Campaign” merchants and have used Payflex at checkout.
2. The prize relating to the “Festive Campaign” is not transferable for cash and no negotiations will be entered into by Payflex or their merchants.
3. Winners shall use the prize at their own risk. Payflex and their merchants shall not be liable for any loss, damage, personal injury, or death that is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with this competition or accepting or using the prize.
4. Payflex, and their merchants / sponsors reserve the right to cancel, modify or amend the competition at any time, if deemed necessary in its opinion, and if circumstances outside of their control should arise.
5. Payflex, and their merchants shall not be liable for any damage caused to prizes because of delivery or dispatch, nor shall they be responsible for any malfunctions or breakages of any prize once delivery has been taken thereof. The Promoter shall further not be held responsible for any accident, injury, harm, or loss due to the acceptance, possession, ownership, or use of the prize without limitation, and are indemnified from any claims that may arise from any participants or winners of this competition or their replacements.
